TERMS OF SERVICE AND CONDITIONS OF USE

Email notifications- You agree that all legal communications and notices may be provided electronically by posting them on our website, or at our election, by sending an email to the email address  you provide to us when you register on our website.  This consent can be revoked by directly contacting customer care.  If you elect to withdraw your consent to electronic communication, you must also discontinue the use of your account on our site.  We are not responsible for email notifications that are redirected due to a customer or user's email filter settings.  It is the responsibility of the user to ensure that the contact information provided to us is correct and receivable.  By using our site and creating an account you agree to receive various  emails from Milwaukee Flyers pursuant to our privacy policy.  

Copyright and trademark information-You the client/customer warrant that the subject matter to be reprinted is not copyrighted by a third party.  Customers also recognize that because subject matter does not have to bear a copyright notice  in order to be protected by copyright law,  the absence of such notices does not necessarily assure a right to reproduce.  The customer further warrants that no copyright notice has been removed from any material used in preparing the subject matter for reproduction.  To support these warranties, customers agree to indemnify and hold Milwaukee Flyers, its partners, affiliates, subsidiaries, and suppliers without liability related to your violation of this agreement.  You agree to indemnify Milwaukee  Flyers, its subsidiaries, affiliates, officers, agents, co branders, vendors, partners, employees  harmless from any claim or demand arising out of content submitted, posted, transmitted or otherwise through Milwaukee flyers.com in violation of these terms or violation of a customers rights of a third party.  You agree to hold us harmless for all liability, damages and attorneys fees that may be incurred if any legal action connected with copyright infringement involving the  work produced or provided.  Customers also warrant that work does not contain anything that is libelous or scandalous, or anything that that threatens anyone's right to privacy or their personal or economic rights. Customers will at their own sole expense promptly and thoroughly defend Milwaukee Flyers in all legal actions on these grounds as long as Milwaukee Flyers notifies the customers of legal action and gives the customer reasonable time to undertake and conduct defense.  Milwaukee Flyers reserves the right to use its discretion  in refusing but not obligated to print anything it deems inappropriate at its discretion.  Your use of our site, your placement  of an order and or your submittal with Milwaukee Flyers indicates your acceptance of  these terms and conditions.  Besides processing your files in preparation of entering the print process, Milwaukee Flyers does not review, edit, correct or pass judgment on any works submitted.   Pursuant to section 512(c) of the Copyright Revision Act, as enacted through the digital Millennium Copyright act, Milwaukee Flyers designates the following individual as its agent for receipt of notifications of claimed copyright infringement

Feedback-Any comments or suggestions, proposals, or other feedback (collectively feedback information) provided to Milwaukee Flyers in connection with the operation or content of this site shall be provided by the submitter and received by Milwaukee Flyers on a non confidential basis. All such comments, suggestions and other information shall become the exclusive property of Milwaukee Flyers.  By submitting any such information to Milwaukee Flyers you agree that you are transferring and assigning, at no charge, all of your right, title and interest in the information, including all copyrights and other intellectual property rights.  You agree that Milwaukee Flyers shall be free to use such information on an unrestricted basis.

Shipping- Milwaukee Flyers ships jobs via UPS, FedEx or other nationally recognized carriers in its sole discretion.  Once the order has shipped, Milwaukee Flyers will not be liable or responsible for late or damaged packages.  Delivery dates ore not guaranteed and may included extended transit time in the case of unforeseen delays caused by weather conditions, shipping company delays, international customs issues or unforeseen acts of God outside the immediate control of Milwaukee Flyers .

Transfer of title-You understand that the shipping terms are FOB shipping point, which means ownership transfers once we delivery  any printed materials  to the shipping carrier.

Change orders/refunds cancellations-All jobs that have been approved or sent to press cannot be altered or changed.  This is due to the automated process.  All sales are considered final and any refund must be approved by management on a case by case basis in the rare event that the error is on the part of Milwaukee Flyers.

Resolution requirements-All files submitted at a minimum of 300dpi high resolution images suited for offset printing.  Milwaukee Flyers will not be responsible for errors or poor resolution as a result of customer providing files that do not meet these minimum requirements.  We reserve the right, but not obligated, to stop  the order progress based on the art.  In this event you will receive communication form us  notifying you of this and your job will be put on hold until you resubmit and reapprove new art or agree to send the job to press as is.  While a job is on hold in this manner, the production time clock is on hold.  Milwaukee Flyers is not responsible for expediting your order if time is lost as a result of the customer's failure to meet production design requirements.  You understand that Milwaukee Flyers does not review, judge, correct, or analyze work submitted by the customer outside of processing for print and is not liable for any mistakes, corrections, loss or otherwise related to work submitted by the customer.  All sales are final.  No refunds are available.  Any refunds partial or otherwise are issued in the form of in house credit and is at the sole discretion of Management. 

Bleed and margin requirements-A bleed margin of 1/8" on all sides for designs which have content extending to the trim line.  Important content shall be within a safety margin of 1/8" inside of the trim line on all sides.  It is important that bleed and safety margins are followed as they are important to Image fidelity.

Right to promotions- Milwaukee Flyers reserves the right that it may use any item produced, either printing or design for file displays, catalogs, flyers, advertisements, website or other promotional uses unless indicated on purchase order invoice or in writing.

Right to subcontract-Milwaukee Flyers retains the right to assign any part of the work required to another contractor within the same quality requirements of Milwaukee Flyers.

Color space conversion-We accept no responsibility for color variations between submitted files and the final printed product.  No reprint or refund will be issued for variations.  Due to limitations of the printing process  and multiple file color balance, the EXACT matching color reproduction is not guaranteed, and by ordering with us you agree to these limitations.  Milwaukee Flyers will not be responsible for any color shifting that occurs in converting from RGB to CMYK color modes.  All files should be submitted in CMYK color space for optimal results.

Black/rich black-Full color jobs that contain large solid areas of  black ink should have the black setup  as CMYK Black (C:60; M:40; Y:40; K:100).  Milwaukee Flyers will not be responsible for printing a consistent , solid and rich black if artwork is not set up to this specification.   Rich black should not be used for text

Turnaround times-Although we make every effort to disclose accurate information for our products; production and delivery times are not contractual.  Turnaround times begin with the receipt of your proof acceptance and turnaround times are accurate under normal circumstances (99%).

Gang run printing-In order for us to provide you with the significant price discounts that we offer, our printing is done in a "gang-run" format which prints it with other jobs on a large sheet.  This allows the price to be spread out over all the jobs in the run lowering the cost.  Every effort is made to produce an accurate representation based on the supplied materials but it is important to understand we do not guarantee 100% exact color matching.   If your job requires EXACT color matching and is color critical, then the necessary attention required is not met by gang run printing.  A Job that is color critical would need to be printed on its own and without the discounted rate of gang run format.  ALL gang run printing is subject to minor color variance.  These jobs require a dedicated run and requires specific color calibration to that specific job.  Because of differences in paper, inks, equipment and other variables between color proofs and the final printed project, variation is normal and expected.  Reasonable variations from monitor settings and performance, printer  or otherwise will differ slightly from the offset printing  and the CMYK process.  These differences in equipment, calibrations, and technologies will not guarantee and exact match.   Files submitted that do not explicitly follow our specifications will not be eligible for reprint or refund.  All work is carried out by skilled professionals, on state of the art equipment, to assure you some of the best printing the industry has to offer.

Overruns and under runs-Industry standards allow for a 10% variance over or under the quantity ordered. The majority of the time we will print slightly more than what you ordered at no additional cost to you.   There may be the possibility that you will receive slightly fewer pieces than you ordered.  We do not guarantee exact count, please select your desired quantity accordingly.

Limitation of liabilities-Milwaukeeflyers.com (Milwaukee Flyers LLC; Homeland Printing LLC) SHALL NOT be liable for any special indirect, consequential, or incidental damages, or damages for loss of revenue, loss of profits, loss of use or otherwise arising out of or related tot this website or the information contained in it, whether such damages arise in contract, negligence, tort, under stature, in equity, at law or otherwise even if Milwaukee  Flyers has been advised of the possibility of such damages.  SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATION OF LIABILITY OR CONSEQUENTIAL DAMAGES, THEREFORE SOME OF THE ABOVE LIMITATIONS ARE NOT APPLICABLE.

Governing jurisdiction-Our website is created, operated and controlled by Milwaukee Flyers in the state of Wisconsin, USA.  As such the laws of the State of Wisconsin without giving effect to any conflicts or principles of laws.  You hereby consent to the exclusive jurisdiction and venue of courts sitting in Wisconsin, Waukesha County in all disputes out of or relating to  the use of our services and/or website.  If it is determined that any part of this  Agreement to be invalid or unenforceable pursuant to applicable law including but not limited to the liability limitations, conditions, or warranty set force within, then the invalid or unenforceable provision and any partially enforceable provision shall not be affected and  will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Alterations/ corrections-Any additional editing, translating or programming needed on customer supplied files can be completed by the customer or choose to have Milwaukee Flyers make the corrections at the rate of $75/hr with a $35 minimum.  Milwaukee Flyers will preflight all digital files received from the customer to determine if they are print ready at no additional charge as part of order processing.  If corrections are needed we will contact you right away and give you the option of making the changes and sending us new files or alternatively having us make the changes.

Terms of sale- To provide the best possible service to our customers , and the way we are setup to operate, once an order has been placed and the order artwork submitted, there is no way to cancel the order, absolutely no exceptions under any circumstance.  Customer agrees that by placing the order with Milwaukee Flyers that it shall be deemed that the service has been incurred and is paying for services provided whether or not the customer agrees to take delivery of the product ordered.  Payment shall be deemed earned in full once the order is placed and artwork is submitted. For which it shall be paid in full.  The customer agrees that by placing an order with us that the order will not and cannot be cancelled or terminated and refuse any payment for service provided.  You also agree that Milwaukee Flyers  is authorized to  use these terms and conditions with any financial institution or credit card company to establish any requested chargeback or refund is invalid and improper.  Any refunds are issued as store credit only and at the sole discretion of the management.

Accuracy of specs- Quotations are based on the accuracy of the specifications provided by you the customer.

Preparatory material-All files provided electronically or on disc, will not be returned to you upon completion of the printing project.  We do not retain any files on behalf of our customers.  Please be sure to keep files and job numbers in a safe place if you expect to reprint the job in the future.  You are solely responsible for maintaining  files.  All materials we create in producing printed products are the exclusive property of Milwaukee Flyers and will not be sold.

Storage-Milwaukee Flyers retains intermediate materials until the project has been printed and accepted by the customer.  Milwaukee Flyers is not responsible for any loss or damage to stored matter. We do not store any customer submitted files after the order has been processed, and reorderds can not be completed without resubmitting artwork

Expiration-Any project that has been in limbo and awaiting clients authorization to proceed which has lasted 6 months or longer shall be considered closed and non refundable after 181 days.  Said order shall be deemed expired and no refund or credit considered.

Customer responsibilities-Customers are 100% responsible for accuracy of the layouts and are encouraged to proof each job carefully.  Customers are also fully responsible  for compliance with postal regulations and current mailing restrictions associated with postcards and mailers.

Prepress proofs-Milwaukee Flyers will submit prepress proofs to the customer for review in accordance with their order.  Customer corrections are to be returned to us as a master set marked OK AS IS, OK with Corrections or Revised proof required and signed (electronically or otherwise) by the customer.  Until the master set is received, no additional work will be performed on the project.  Milwaukee Flyers is not responsible for undetected production errors where a proof is not required by the customer, the work is printed with the customer's signed OK, or any requests for changes that are communicated orally.

Use of website-Our website and the contents are intended solely for your personal, non commercial use.  You may download or copy the content and /or other downloadable materials displayed on the website for your personal use only; provided that you also retain all copyright, trademark and other proprietary notices contained in the material, do not modify or alter trademark and other proprietary notices contained in the material, do not modify or alter the material and do not copy or post the material on any network computer or broadcast the material in any media.  It is strictly prohibited to modify , transmit, distribute, reuse, repost, "frame" or use the content for public or commercial purposes without written consent from Milwaukee Flyers.  No right, title or interest in any downloaded materials or software is transferred to you as a result of any such action.  You may not reproduce and  except as noted above, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale, exploit in any way in whole or in part any of the contents, the website or any related intellectual property.  You agree that if Milwaukee Flyers in our sole discretion, requests in writing that you remove any link or links to our website, you will promptly do so.  You agree that we may, in our sole discretion, and at any time, terminate your access to and use of our website or any part thereof, with or without notice.

Security-By using our service you agree that you will not attempt to undermine the integrity of Milwaukee flyers website.  Tampering with our website, misrepresenting the identity of a user, using buying agents or conducting fraudulent activities on our website is prohibited.  Users are prohibited from violating or attempting to violate the security of our website, including, without limitation, (a) accessing data not intended for such user or logging onto a server or an account which the user is not authorized to access; (b) using our website for unintended purposes or trying to change the behavior  or integrity of our website; (c) attempting to probe, scan or test the vulnerability of a system or network or breach security or authentication measures without proper authorization; (d) attempting to interfere with service to any user, host or network, including without limitations means of submitting a virus to our website, overloading, "flooding", "spamming", "mail bombing" or "crashing"; (f) forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting.  Violations of system or Network security may result in civil or criminal liability; (g) forging communications on behalf of our website (impersonating our website) or to our website (impersonating a legitimate user).  Sending unsolicited and unauthorized email on behalf of Milwaukee Flyers  including promotions and/or advertising of products or services, is expressly prohibited.  You agree not to use any device, software, routine or data to interfere or attempt to interfere with the proper function

These terms and conditions shall supersede any subsequent terms and conditions included with any purchase order, whether or not such terms and conditions are signed by Milwaukee Flyers.  User assumes all knowledge of applicable law and is responsible for compliance with any such laws.  You may not use the service in any way that violates applicable state, federal, or international laws, regulations or other government requirements.  You further agree not to transmit any materials that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation.  We reserve the right to make changes to the terms and conditions and website at any time without notice.
